1. Agreement to These Terms
This website (the "Site") is published by Johnny Chal Legal (ABN 62 414 471 860), a legal practice regulated by the Legal Profession Uniform Law (NSW) and the Law Society of New South Wales. References to "we", "us", "our" or "the practice" are references to Johnny Chal Legal and its principal, Johnny Chal.
By accessing or using the Site, including by submitting an enquiry, you agree to be bound by these Terms of Use. We may amend these Terms of Use at our discretion and without prior notice; amendments take effect immediately on publication, and your continued use of the Site after that point constitutes acceptance of the amended terms. The current version always applies.
Our Privacy Policy and our AI Use Policy apply to your use of this Site and to any information you provide through our contact or enquiry forms. Both form part of these Terms of Use and are incorporated into them by reference.
2. No Solicitor-Client Relationship
Use of this Site, including submission of an enquiry, does not create a solicitor-client relationship between you and Johnny Chal Legal. A solicitor-client relationship is formed only once we have confirmed instructions in writing and issued a Costs Agreement and Letter of Engagement. Until then, we owe you no duty of care and hold no privilege or confidentiality obligation over anything you send us through the Site.
3. General Information Only, Not Legal Advice
Content published on this Site, including articles, commentary and any other material, is general information only and is not intended to be comprehensive. It does not constitute legal advice and must not be relied on as such. You should always obtain advice specific to your circumstances before acting, or deciding not to act, on anything you read here.
We aim to keep content current and accurate at the time of publication, but laws, regulatory guidance and industry practice change. Older articles may no longer reflect the present state of the law. We do not warrant the currency, completeness or accuracy of any material on the Site.
4. Intellectual Property
All content on the Site, including text, articles, graphics, logos and the "ink and ember" brand identity, is owned by or licensed to Johnny Chal Legal and is protected by copyright. "Johnny Chal Legal" and associated logos are unregistered trade marks proprietary to the practice.
You may view, download or print pages of the Site for your own personal or internal, non-commercial use, provided you do not remove any copyright or trade mark notice. Beyond that, no part of the Site may be reproduced, republished, adapted, distributed, sold, or used to create derivative works, without our prior written consent. You may not frame, embed, or deep-link to Site content in a way that misattributes its source without our prior written consent.
5. Acceptable Use
In using the Site, you must not:
— impersonate, or attempt to impersonate, Johnny Chal Legal, its principal, or any other person
— use the Site in a way that is unlawful, fraudulent, or intended to harm, disrupt, or interfere with the Site or other users
— attempt to gain unauthorised access to any part of the Site, or to any system or network connected to it
— use any robot, spider, scraper or other automated means to access, monitor, or copy content from the Site, other than standard search-engine indexing
— submit any comment, enquiry, or content through the Site that is defamatory, harassing, obscene, discriminatory, or otherwise unlawful
We may report suspected fraudulent, abusive or unlawful activity to the relevant authorities, cooperate with any resulting investigation, and suspend or terminate your access to the Site for breach of this clause.
6. Third-Party Links
The Site may link to external websites for your convenience. We do not control, endorse, or accept responsibility for the content, accuracy, or privacy practices of any linked site, and your use of those sites is governed by their own terms. Inclusion of a link does not imply any association with or recommendation of that third party.
7. Availability and Disclaimer of Warranties
The Site and its content are provided on an "as is" and "as available" basis. We do not warrant that the Site will be uninterrupted, secure, or free of errors, viruses, or other harmful components, and we may suspend, withdraw, or restrict access to all or part of the Site at any time, for any reason, without notice.
To the maximum extent permitted by law, we exclude all conditions, warranties and terms that would otherwise be implied into these Terms of Use by statute, custom, or the general law. Where a warranty cannot lawfully be excluded, our liability for breach of it is limited, to the maximum extent the law allows, to resupply of the relevant service or the cost of having it resupplied.
8. Consumer Guarantees
Nothing in these Terms of Use excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded. To the extent the Australian Consumer Law permits us to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our election, to the re-supply of the relevant service or payment of the cost of having it re-supplied.
9. Limitation and Exclusion of Liability
Subject to clause 8, and to the maximum extent permitted by law, we exclude all liability, whether in contract, tort (including negligence), statute or otherwise, for any direct, indirect, or consequential loss or damage arising out of or in connection with the Site, its content, or your use of it. This includes, without limitation, loss of data, loss of business, loss of opportunity, or damage to your device or systems, even where we have been advised of the possibility of such loss.

10. Our Use of Artificial Intelligence on This Site
From time to time, content on this Site may be prepared with the assistance of AI tools, always under the review and final authorship of a solicitor. Any AI-assisted content is treated as a starting draft only, never as automated output published without human oversight. Our full approach to AI — including the specific tools we use, such as Plaud for meeting transcription, and what we do not do with client information — is set out in our AI Use Policy, which forms part of these Terms of Use by reference.
11. Governing Law
These Terms of Use, and your use of the Site, are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales in respect of any dispute arising out of or in connection with these Terms of Use.
